Today, we’re going to be talking about whether or not it matters what you slipped on at a store. Now, I’ve had clients that have slipped on all kinds of things, everything from water that was spilled to a fruit peel.
It actually does make a pretty big difference. One client of mine had clear soap on a tile floor. Couldn’t see it at all. He slipped, fell, and tore up quite a bit of stuff in his knee.
I’ve had another client who was walking in a store and there was bright red fruit punch on a white tile floor and they still slipped on it. Now, the primary difference between those two was that one was considered open and obvious and the other wasn’t.
If the store can say, “Oh, well, you clearly should have seen that there was this liquid on the floor, as is in the case of the red fruit punch, then they can try to claim that you should have known it was there and shouldn’t have slipped on it.
