Today we’re going to be discussing whether or not the establishment that provided alcohol to the intoxicated individual who hit you with their car is partially responsible. Now in Oklahoma, we have a series of laws called DRAM shop laws that relate specifically to this issue.
Now, historically, a DRAM shop is anywhere that provides alcohol to an individual, be that a convenience store, a liquor store, restaurant, anything like that. And if those establishments provide alcohol to a noticeably intoxicated person, there’s a chance that they might be liable for what that person does.
Previously had an incident in which a person was heavily intoxicated, went into a bar, proceed to get more intoxicated than left, got in their vehicle and ran a red light, and struck our client. And we were able to make the bar itself a party in the eventual lawsuit.
