Today, we’re going to be discussing whether or not you have to file a lawsuit if you file an insurance claim.
The shorter answer is, you don’t. Now with the vast majority of our clients, what we try to do is work with the insurance company to reach a satisfactory resolution, if possible and within reason, meaning after we’ve taken all the damages of our client if we can negotiate with the insurance company a resolution that our client is happy with.
At the end of the day, they’re the ones who sign off on everything. Now, sometimes that isn’t the case. We might have an insurance company that will deny liability or says that they’re only going to cover a portion of our client’s damages.
And in those cases, we might be forced to file a lawsuit. Now, it’s very important whenever you’re sitting down and trying to decide which legal counsel to go with, to make sure that that council is going to be fighting for your rights.
