Hire Legal Counsel That Will Fight for You

Video Transcribed: If you file an insurance claim, do you have to file a lawsuit? Hey everyone, Christopher Stevens here certified paralegal with the Wirth Law Office in Tulsa, Oklahoma, working in personal injury in Oklahoma. Today, we’re going to be discussing whether or not you have to file a lawsuit if you file an insurance claim.

The shorter answer is, you don’t. Now with the vast majority of our clients, what we try to do is work with the insurance company to reach a satisfactory resolution, if possible and within reason, meaning after we’ve taken all the damages of our client if we can negotiate with the insurance company a resolution that our client is happy with.

At the end of the day, they’re the ones who sign off on everything. Now, sometimes that isn’t the case. We might have an insurance company that will deny liability or says that they’re only going to cover a portion of our client’s damages.

And in those cases, we might be forced to file a lawsuit. Now, it’s very important whenever you’re sitting down and trying to decide which legal counsel to go with, to make sure that that council is going to be fighting for your rights.

There are some firms out there that don’t do lawsuits. They will always try to settle pre-litigation, and if it comes to a lawsuit, then they’ll refer the case out. So that’s something that you should not be afraid at all to speak with any potential legal counsel about.

Make sure that the firm you’re going with is also the firm that is willing to take your case as far as it needs to go to get you your justice.  If you need a personal injury attorney in Tulsa in which you are seeking legal help concerning your accident, feel free to contact an Oklahoma Personal Injury Attorney.
