I’m Tulsa Traffic Ticket Attorney James Wirth, and we’re talking about the driver’s license point system. The Department of Public Safety that when you get a conviction for a traffic offense, there are 63 different violations that result in points either one, two, three, or four points. And the question is, which of those infractions result in three points on your driver’s license?
There are only three of them, and they are speeding, but only speeding when it’s 26 to 40 over. If it’s more than 40 over, then you’re looking at four points on your license. If it’s less, then it’s either two points.
Or if it’s one to 10 over, and it’s not in a construction zone, school zone, or anything like that, then it’s zero points on your license. But if it’s 26 to 40 miles per hour over the speed limit, then it is three points on your license.
The other ones are inattentive driving resulting in a collision. That’s three points on your driver’s license. And the last one is improper passing when it’s a failure to slow or move over as required. Then it’s three points or your license. If it’s just simple improper passing, that’s only one point.
But when it involves failure to slow or move over as required, perhaps for an emergency vehicle, something along those lines, then it’s three points on your driver’s license.
And if you get up to 10 points within a five-year period, you lose your right to drive.
