The Party’s Income Plays a Major Factor in Child Support Payments
Video Transcribed: Do gambling winnings count towards your income for the purposes of determining child support in Oklahoma? I’m Oklahoma attorney James Wirth. I’m doing a series of videos related to Oklahoma child support and we’re covering some definitions.
And the main factor in determining how much somebody pays in child support is the party’s income. So the question becomes, what’s included in the income that you put in there and what is not? And it includes both earned income and passive income.
And as part of the passive income, it lists a number of things. And this is statutory. It’s Title 43, Section 118-B, Subsection A3 regards passive income. And under Subsection 3, you can go down to Subsection N and that includes gambling winnings.
And you go down one stage below that Subsection O and it includes lottery winning. So specifically by statute, lottery winnings and gambling winnings are included as part of your gross income for determining how much your child support should be.
