Understanding Lauria & Ashley’s Law
Hey guys, it’s Carl Birkhead here. I’m a Tulsa felony defense attorney with Wirth Law Office, and I’ve been practicing criminal law for about eight years now. I want to help you make law easy by talking about a statute that’s going to be changed and go into effect starting in the new year, and it’s going to affect specifically people who are charged as accessories to first or second degree murder.
Okay, so this law is called Lauria and Ashley’s Law. It’s based on a case from back in way back, where someone was in jail, in prison for a crime for being an accessory to murder or second-degree murder. They were released early on good behavior, and after they were released, they re-offended. Two little girls lost their lives.
Impact of the New Legislation
Because of that, now the law has finally been changed to where when you are charged as an accessory to murder, either in the first or in the second degree, you are not eligible for release for good behavior until you’ve served 85% of your time. Basically, it’s now going to be considered an 85% crime because you cannot get out early until you’ve served the vast majority of it.
If you’re in this situation, if you’re charged with accessory to first or second degree murder, you absolutely have to be aware of the fact that you’re going to be facing a harsher punishment and a longer prison time starting in 2026.
