Responsibilities and Changes After Guardian Appointment Explained
Hello, this is Tulsa family law attorney Brian Carter with the Wirth Law Office. This is part two of my video on legal guardianship. In part one, I explained what a legal guardian is and how the process works. In this video, I’ll go a step further and talk about what happens after a guardian is appointed and the responsibilities that come with it.
What Happens After Appointment?
Once a guardian is appointed, that person takes over the rights and responsibilities of caring for the minor child or incapacitated adult. As I mentioned earlier, the court will require annual reports to update what is happening with the ward.
For minors, the guardian makes all decisions in the child’s best interest—things like education, healthcare, and daily needs—while also ensuring financial obligations are met.
Modifying or Terminating Guardianships
Guardianships are intended to be permanent, but they can be modified or terminated under certain circumstances. For example, a guardianship for a minor ends when the child reaches the age of majority. If an incapacitated adult regains capacity, the guardianship can be terminated. And if circumstances change and a different guardian needs to be appointed, the court has a process for that as well.
