So, I will be talking about this specifically in the context of family cases, such as divorce and paternity orders. A proffer hearing typically occurs at the early stages when you’re trying to get a temporary order. Here’s how it works: a proffer hearing is essentially a sneak preview or a short synopsis of what an actual litigated hearing will entail.
The Role of Proffer Hearings
Usually, this process is used in larger counties where court dockets are extensive, and there isn’t enough time to dedicate three to six hours or a full day to litigate a temporary order. Hence, the hearing gets condensed to its most fundamental elements so the judge can decide for temporary purposes while the case unfolds.
In these hearings, each side typically gets 15 to 30 minutes. There are no witnesses on the stand, and neither you nor your ex will testify. Instead, your attorneys will present arguments. I recently had one where the petitioner’s attorney presented their side, and then I countered their points.
What to Expect During a Proffer Hearing
Very little evidence is usually introduced at these hearings. In my recent experience, we used only a breakdown of each side’s monthly budget to assist in figuring out property split, debt distribution, child support, and alimony. This helps the court understand the financial dynamics to decide who is responsible for what as the case progresses.
If your attorney informs you about an upcoming proffer hearing, this is what you can expect. You probably won’t need to speak much. Your lawyer will make the necessary arguments on your behalf, outlining what a full hearing might look like if it were permitted.
