Video Transcribed: Hello, my name is Jason Lile; I am a Tulsa Criminal defense attorney. I would like to talk to you today about violent crimes. If you have been charged with something, or you are suspected of, or you’re being investigated for something that might be a violent crime, you need to know. You must immediately hire an experienced criminal defense lawyer, and I’ll tell you why.
Violent crimes in Oklahoma… I will look at a list, so I don’t miss any. Assault, aggravated assault, assault and battery, assault with a dangerous weapon, assault with a deadly weapon, armed robbery, domestic violence, gun crime, homicide, obviously in all its degrees, and rape or violence sex crimes. If the crime you’re suspected of, accused of, or charged with falls on those lists, it’s essential to get your resources together and hire an experienced defense attorney.
One of the main reasons is that many of those charges I just listed are subject to the 85% rule. What is the 85% rule? It means that if you’re convicted, and let’s say that you’re convicted 10 years or 20 years in prison, you must, under all circumstances, serve 85% of the time. This enhancement means that you’re looking at more jail time without a possibility of parole until 85% of the time’s been served.
Another thing is if you’re charged with assault, there’s a wide range of aggravating factors that make simple assault worse. It could be assault. It could be assault and battery, and assault and battery are when you make contact with somebody that’s unwanted.
It could be domestic abuse, which is kind of self-explanatory. It could be aggravated assault perpetrated by a robust and healthy individual against somebody less strong or less healthy, for example. It can be assault with a dangerous weapon, different from a deadly one.
