Essential Steps to Take After Being Arrested
Hello, this is Tulsa criminal attorney Brian Carter with the Wirth Law Office, and in this video, I’m going to talk about what you should do if you are arrested. First and foremost, and probably the most important, is that you have the right to remain silent, and you must use it. You do not have to speak to law enforcement.
You also have the right to an attorney, and you don’t have to make statements to law enforcement. Often times too, there is a vehicle or other property involved when law enforcement encounters and they may ask for your consent to search.
Your Right to Consent
Never give consent to search whether or not there is anything in the vehicle that is problematic or not. Make them get a warrant and do their job. Police can’t arrest you without probable cause, and refusing to give a statement or allow a search does not constitute probable cause.
