So this is going to focus on cases that result in a conviction. There are numerous instances where the state may choose not to file charges, dismiss them after filing, or amend the charges. In some instances, the state might not dismiss or amend, but you might receive a deferred probationary period. This means you are convicted, but after meeting certain requirements, the case is dismissed from your record.
Conviction and Sentencing Options
If those options aren’t available, and you’re convicted of a crime, you could face different outcomes, like jail or a suspended sentence. Whether it’s a misdemeanor or a felony, the options vary. A suspended sentence means being on probation. For instance, a two-year suspended sentence means the court finds you guilty and sentences you to jail for two years, but allows you to serve this time outside jail under probation.
Without a suspended sentence, the only option is actual jail or prison time. For misdemeanors, it’s county jail; for felonies, it’s state penitentiary. The length of time depends on the crime, ranging from a misdemeanor with up to six months to a felony that could mean life imprisonment. It really varies with each case.
