
Understanding the Seriousness of Testing in Drug Court
So, you’re in drug court and you’re pretty sure you’re going to test positive for your next drug test. What do you do? My name is Carl Birkhead. Dealing with the Pressure
This came up recently in a couple of cases that I had, where I had an individual who was supposed to be going to drug court and supposed to be taking their drug tests. They tried to fake the drug test. It’s very difficult to fake these types of drug tests because someone’s usually watching you complete the UA test.
For whatever reason, they were trying to doctor the test. They were trying to get around the actual taking of the test because they were pretty sure it would come back positive. Want to know the number one way to get kicked out of drug court fast? Start messing with the drug test results. They are very strict about this.
The Importance of Integrity in Testing
The rationale behind this rule in drug court is to maintain the integrity of the testing system. They need to trust the test results, whether positive or negative. If you’re caught faking one test, they’re going to assume you faked all tests. The system assumes you will continue to fake more tests, leading to expulsion from the program.
There’s very little wiggle room and minimal grace given in these situations. If you’re in this situation, I cannot stress this enough. It’s better to have a positive drug test than to get caught trying to alter the results. Save yourself some headaches, save yourself heartache, and just take the test honestly.
