Gang-Related Crimes
What is a gang-related offense in Oklahoma? I’m Tulsa Attorney James Wirth, and we’re talking about a statute in Oklahoma that makes it a crime to commit a gang-related offense. And that can be found under Oklahoma law title 21 section 856.3, that statute from 2011. It did not exist prior to 2011, but since 2011 that has been a crime. And what it provides is that any person who attempts to, or I’m sorry, attempts or commits a gang-related offense as a condition of membership in a criminal street gang, or while in association with any criminal street gang or gang members shall be guilty of a felony, which upon conviction you can be sentenced up to five years in the Department of Corrections.
Defining Criminal Street Gangs
So what is a criminal street gang? How is that defined? What is gang-related offense? What does that mean? Well, we’ve got additional laws on that. So I’m looking at title 21 section 856. It has a list of offenses. It also defines criminal street gangs. What is a criminal street gang? Under Oklahoma law it says, means any ongoing organization, association, or group of five or more persons. So if you have less than five, I guess it’s not a criminal street gang. Or more persons that specifically either promote, sponsors, or assist in, or participates in, and requires that a condition of membership or continued membership, the commission of one or more of the following acts.
Acts Considered Gang-Related
It’s basically an organization with five or more people that requires you to commit certain criminal offenses. And those criminal offenses are assault, battery, assault and battery with a deadly weapon, aggravated assault and battery, robbery by force or fear, robbery or attempted robbery with a dangerous weapon, homicide, manslaughter, sale, possession, trade, manufacture of CDS, controlled dangerous substances, trafficking illegal drugs, arson, influence or intimidation of a witness, theft of a vehicle, rape, extortion, transporting of a loaded firearm, possession of a concealed weapon, shooting or discharging firearm, soliciting another to commit an act of prostitution, human trafficking, possession of a firearm after former conviction of a felony. So that is the list of the offenses which are considered gang-related as well as the definition of criminal street gang.
