
Understanding the Basics of Statutes of Limitations
Hello, Tulsa misdemeanor attorney Brian Carter with the Wirth Law Office, and in this video, I’m going to discuss the difference in the statute of limitations in Oklahoma between misdemeanors and felonies. With a misdemeanor, the statute of limitations is three years, and with most felonies, it’s five.
However, there are some exceptions for murder, child sex crimes, and in some instances, fraud. That being said, there are situations where a statute of limitations can be pulled or suspended.
Exceptions and Special Circumstances
In cases where a defendant is outside the state of Oklahoma or cannot be found, or a statute involving a minor child might not begin to run until that child turns 18. Additionally, in cases of fraud or financial crime, the statute won’t begin to run until that crime is discovered.
