The Purpose of a Guardian Ad Litem

A guardian ad litem is an attorney appointed by the court to advocate for the children. This is especially important in cases where there are allegations involving the children, particularly when the children are very young and cannot adequately speak for themselves.

The guardian ad litem will meet with all the parties—both parents, the children, and sometimes other individuals involved in the case—and then present a report to the court. Courts give significant weight to a guardian ad litem’s findings. This can be especially helpful in contentious custody disputes where the children are caught in the middle of allegations.

Benefits of a Guardian Ad Litem

Another benefit of having a guardian ad litem is that it helps avoid issues with the child hearsay rule, which I plan to discuss in a future video.
