Defendant’s Arraignment Warning: What Not to Do
Hello. This is Tulsa criminal attorney Brian Carter with the Wirth Law Office. In this video, I’m going to talk about the number one thing a defendant should never do at an arraignment, and that is try to plead your case in front of the judge.
This is important because you run the risk of incriminating yourself and creating a bunch of witnesses against you in the courtroom. Oftentimes, there will be a prosecutor on that arraignment docket as well.
The Risks of Speaking Out
It’s crucial to understand that speaking too much or inappropriately during an arraignment can harm your case. The courtroom is not the place to argue or present your full defense.
If you’re going to enter a not guilty plea on your behalf at that time, do so, or what is preferred is to ask for more time to seek legal counsel.
Seek Professional Legal Advice
Contacting a lawyer before making any statements is critical. Legal professionals can guide you on the best approach and ensure that your rights are protected.
