The Answer Is You Can’t

My name is Brian L. Jackson. I am one of the Criminal Attorneys in Tulsa, Oklahoma with the Wirth Law Office. So you’re in drug court and you’re wondering if you can use CBD products, not cannabis products, but CBD products for a medical ailment while in drug court. The answer is you can’t.
It’s prohibited their state policy for drug courts. And many of the local rules for drug courts also prohibit the use of CBD. But a separate problem with CBD, like some other substances that you can come across as a drug court participant, is that it can cause you to pop hot for THC, which is the active ingredient in marijuana, even if you haven’t been using it.
So this is an example of one of a number of substances that, generally speaking, it’s a good idea if you’re participating in drug court to stay the hell away from unless you have specific permission to use that substance from the program.
Some other examples of substances you need to stay away from including anything that contains dextromethorphan, which is pretty common in a lot of cough suppressants, anything that contains amphetamine or an amphetamine analog, any kind of designer drugs that might cause you to pop hot or that might be otherwise prohibited you should stay away from, and anything that has an opium content that might cause you to test hot for opioids or heroin.
There are some things discussed as to whether or not poppy seed foods can make you pop hot. Some people say it can, some people say it can’t.
If you want to stay out of trouble, your best bet is don’t eat that stuff because the usual position of the compliance officers and the drug court team is going to be that if you pop hot, that’s your problem.
And if you were consuming a product you weren’t supposed to consume or that would make you pop hot, then you were doing something wrong, even if it is not per se prohibited.
The rule is generally if you pop hot, you’re in violation and it doesn’t matter whether you really did take that substance or not. So it’s something to be mindful of if you are a participant in drug court.
Now, this isn’t to say that you shouldn’t participate in drug court. It’s just, again, a heads up to those of you who are in drug court or thinking of participating in drug court.
