Video Transcribed: What is a tort in Oklahoma Civil Litigation? I’m Tulsa attorney James Wirth. That’s the question that we have is, what is a tort?
All right, so if we’re filing things in the court, there’s a number of different types of things. So we’ve got criminal filings, criminal charges can be filed. Those are filed by prosecutors. And then on the other side, we have civil, and there are many different types of civil things. So you could file a breach of contract, disputes related to that, domestic disputes. There are all sorts of civil litigation types that you could do, but one type is called a tort and it’s a specific type of cause of action. There are a number of torts under Oklahoma law, so if you file a negligence claim, that is a tort negligence claim. Trespassing, you can file as a tort. In Oklahoma law trespass to chattel deals with trespass, but not to real property, to personal property. Conversion is taking something that is someone else’s and making it into your own to use.
Product liability, that’s another type of tort. Assault is a tort, that’s an intentional tort. It can be filed as a civil lawsuit. Battery, those are a crime, but it can also be filed as a civil tort. The intentional affliction of emotional distress, defamation, slander, all of those things are types of torts. It’s a type of civil litigation that can be filed in Oklahoma.
