Locust Grove Dog Mistreatment Lawsuit
Tulsa attorney James Wirth weighed in on a lawsuit that has recently rocked the small town of Locust Grove, Oklahoma. At the heart of the matter is a multi-million-dollar lawsuit filed against the city and the Locust Grove police by a resident, alleging severe mistreatment of dogs by law enforcement officers.
In August 2022, the incident unfolded when two Locust Grove officers responded to a complaint about dogs running at large on a resident’s property. However, according to the owner’s account, the dogs were peacefully sitting in their front yard, posing no threat to anyone.
Mark Lyons, the plaintiff’s attorney, expressed outrage over the officers’ decision to resort to lethal force, stating, I mean I just don’t see how anybody with any sense of humanity could take a dog out and, boom, shoot it in the head.
Officers’ Use of Coercion and Disregard for Proper Protocols
The situation took a disturbing turn when the officers allegedly threatened the owner with $175 tickets for her dogs or surrendering them, a decision she made due to her inability to pay the fines. This compelled declaration allowed the officers to take the dogs away and, shockingly, shoot both of them in the head.
James Wirth pointed out several critical issues with the incident. Firstly, the officers’ use of coercion to label the dogs as abandoned due to the threat of citations raised significant concerns. Secondly, established procedures for handling animals, involving animal control and notifications to owners, were blatantly disregarded in this case.
Instead of adhering to the proper protocols, the officers reportedly took the dogs a short distance away and shot them. To everyone’s astonishment, one of the dogs miraculously survived and returned home eight days later.
Allegations of Animal Cruelty and Attempted Cover-Up
The owner reported the incident as an act of animal cruelty, but instead of an apology, an officer offered to dispose of the surviving dog once more. Wirth speculated that this move might have been an attempt to conceal their actions or mitigate potential allegations.
The plaintiff’s attorney documented the shocking interaction, expressing her fury and disbelief over the events. Wirth highlighted that this case stands apart from those involving dangerous dogs where officers can typically claim self-defense. In this instance, it appears to be an informal policy to euthanize dogs by shooting them, raising serious legal concerns given Oklahoma’s animal cruelty statute.
Importance of Holding Law Enforcement Accountable
NewsChannel 8 sought comments from the Locust Grove Police Department and the city, but both declined to comment due to the ongoing lawsuit. The officers involved assert that their actions were aimed at maintaining public peace, a claim that James Wirth believes should be determined by a jury. His involvement in this case underscores the significance of addressing the conduct of local law enforcement and its potential impact on the community.
